Mesa County Clerk & Recorder - Announcement concerning Marriage Licenses

The following announcement is provided on behalf of Sheila Reiner, Mesa County Clerk & Recorder:

"I am receiving many questions and comments on the topic of the issuance of same sex marriage licenses in Mesa County. I would like to update the citizens of Mesa County on my intent.

On June 25th the US 10th Circuit Court of Appeals ruled that Utah’s ban on same-sex marriage was a violation of the United States constitution and violates Due Process and Equal Protection. The Court then immediately stayed (put on hold) their decision pending a ruling from the Supreme Court.

Immediately following the order that was issued by the US 10th Circuit Court of Appeals, Boulder County began to issue same-sex marriage licenses.

On July 1st a federal lawsuit was filed in Jefferson County to require the issuance of same-sex marriage licenses. That case hasn't been scheduled yet.

On July 9th an Adams County judge found similarly with the 10th Circuit Court of Appeals and also immediately stayed their decision pending the higher court's ruling. This case only has jurisdiction in that judicial district.

On July 10th a Boulder County judge denied the Attorney General’s petition to stop the Boulder County Clerk from issuing licenses. Subsequently Denver and Pueblo Counties are now issuing them.

The wishes of our community weigh heavily on my mind and so does the oath I took when I was sworn into office here in Mesa County. I believe that legalized issuance of same-sex marriage licenses in Colorado is imminent. When it is legally clear Mesa County will issue them. In the mean time, I have taken an oath to follow the laws of the state of Colorado, not to interpret them.

I appreciate the comments I have received as well as your continued understanding and patience with my office and me as the legal landscape on this issue continues to develop."

INside Mesa County: Know Your Government

This year's INside Mesa County class begins September 25th and runs through December 4th. Classes are on Thursday evenings from 6 - 8:30 p.m. and optional tours will be offered on Tuesdays at Noon. This FREE 10-week course includes presentations from your elected and appointed officials, as well as tours of Mesa County facilities.

INside Mesa County classes offer you a front seat to learn about Mesa County Government, providing information about the function and responsibilities of your county government. It also offers outstanding networking opportunities and prepares residents for leadership roles with Mesa County government, commissioners and boards.
